Bart Ticket Gate (Fare Gate) Accident

It does sound like this rider suffered a very serious injury as a result of this, and I too am shocked that the faregates could have caused it. Who would've thought?!

If the injury was a serious as he makes it sound on here, hopefully he notified a Station Agent, who called 9-1-1 and summoned the fire department and an ambulance, so that he received emergency medical attention. It must've been quite some hit in order to cause a hematoma. I'm sure that if EMS was summoned, a report was taken by a BART Police officer about this injury which was sustained on BART property.

Also, if it happened in the faregates area, it should be on camera, which should make your case against BART that much easier.

Get well soon, and hopefully, after (by your own admission) "Hematoma, Complicated Inflamed/Infected Hematoma, MRI, CAT Scan, Sonagrams, two Overnite Emergency Ward Admits,and 5 Acute Surgery Clinics and six months later, I am left with the possibility of a blood clot breaking loose and and damaging my ticker, or a stroke that paves my way to the grave or a wheelchair" you feel better.

Anyone else have any input on this?

Maybe it was a malfunctioning gate, but I'd think unless it malfunctioned badly it would be pretty hard to get seriously injured on the gates. You're probably more likely to get injured in the door to your house or a revolving door than the BART gates.

I always LMAO when people stick their ticket in the gate and try to charge through when they don't have enough fare and they walk into the barrier. It's even better when the people behind are sticking their ticket in and run into them. But then there is a whole mess of them standing in front of everyone and slowly and stupidly reading how much money they have and holding the whole line up. This is when you should get out of the way and resolve your fare issue while NOT IN LINE.

HINT: If you are going to stare at your ticket, or read your book, or talk on your cell phone while ignoring everything around you, then you should not be in a line (to go down the stairs, or buy tickets or enter/exit the station). Everyone else wants to get on with their lives. If you are too distracted to move with the line in a timely manner then move out of the way until the crowd dies down and then play games at the gates by yourself without wasting the life of everyone around you.

My other pet peeve is the exit-lane switchers who try to jump from one gate to another at the last second when the person in front of them turns out to be an idiot. Sorry, having an idiot in front of you doesn't give you a free ride to cut in the other line of people at the last second. Or there are the people that don't choose a line, even though there are clearly 2 lines for the exit gates.

I specifically look for idiots around me (reading books while walking, obliviously taking on cell phone) and try to be certain I don't end up behind them in the line when exiting the station. The people who are distracted to begin with usually end up being the ones who don't have enough money on their tickets and then stand in everyone else's way for half a minute while reading their ticket or try their low fare ticket multiple times as if it will fix the problem to try it a hundred more times.

administration. I did not come here to discuss details of the case. That is not appropriate. I am glad I can share a few legal nuggets, such as the need to report the accident within 6 months of the event. My medical condition did not kick into high gear until months 4-6. I was willing to wait out the hematoma - but it has caused 2 overnites in the emergency ward,tests ranging from ok to torture (MRI),pain, stress,6 visits to the acute care surgery clinic, and it ain't over yet!

The other thing i have found out over the years.. If you stay behind your ticket, it will not close on you..

When you see someone pick up their ticket, is it next to them or in front of them..

From years of watching and experimenting..

If you get hit, generally you are picking up the ticket when it's next to you.. I also see people draping coats, purse, whatever over the barrier when they use their ticket, and they'll get hit.. I even laugh when i see people put tickets in and run into the barrier, they don't even wait for it to open..

If you put the ticket in.. and then pick it up with your arm in front of you, the barrier will open and wait for you to walk through.

What I hate are the barriers where one opens faster than the other.. It can catch you in an unpleasant way.. Oh and I have been hit lots of times by all kinds of barriers BART has.. Whoever was sueing, must have had a preexisting condition that the barrier hit and made worse..

Sheesh the train doors have more of an impact than the barriers..

I thought the gates at the super secret underwater transbay tuborium station were made out of recovered mystery super-metal from alien implants, not ceramic. Did I get my BART facts wrong?

That would be Un-American... American's like to sue, and judges and juries like to make companies pay..

There are people out there that make a living with lawsuits.. but don't blame them, blame who awards it to them..

Only in america, can someone sue because their coffee was hot.. Or hurt yourself breaking into a home and sue the homeowner..

Taking responsibility for your actions is not the American way.. Many generations ago you could just pick yourself up, rub dirt in the wound ( or dust off) and say that sucks, maybe I should have picked up my feet when walking.

Now we can sue because the ground was uneven.. (The world is still flat right?)

BART TICKET GATE ACCIDENT AND LEGAL STUFF

Almost six months ago the BART automatic ticket gate (aka Fare Gate) slammed closed on my upper leg. EXCRUCIATING pain for about 30 seconds. Three weeks after the impact I am in the hospital with a hematoma. Bled twice extensively before becoming really enlarged,inflamed and infected in the last 2 months. - Acute Care, 2 overnight emergency ward stays, 6 acute surgery clinic visits, cat scan, sonagrams, MRI, biopsy, scheduled for surgery. Pain, fever, loss of work, mobility problems, possibility of blod clot breaking off and causing a stroke or heart attack. I shared the accident with only a few friends and acquaintances and found out about other adults being hit also by the ticket (fare) gate pinchers. I then asked two BART employees in different stations if they knew of others being slammed by the pinchers. I was told CHILDREN are hit in the HEAD! SO, my motivation is two fold. 1) Fair compensation. 2) To alert the public to the danger to adults and children. LEGAL STUFF: One needs to file a claim with the BART Risk and Insurance Management Office before the 6 month statute of limitations. This is different than the incident report filed on the spot. I also recommend you at least do an initial consult with a lawyer so you are aware of your legal options. Personal injury lawyers charge a percentage which means there is no cash outlay. You can also represent yourself, and that sometimes means a larger settlement in your pocket. If you do not have a lawyer the BART process is that you will be contacted by BART Claim Administrators to make a recorded statement and for permission to look at your medical records. I would rather do this with a lawyer. How do I know all this? I started calling personal injury lawyers. Then I found some specializing in BART cases. BART informed me of the procedure about filing and the next step of the administrators. In an attorney consult (free) I was told I do not need to see the administrators without an attorney present; They will then automatically deny my claim, and I have six months to make a legal case. I also recommend you make enough calls to lawyers to find one who has compassion, integrity, and the expertise. It took me 10 calls to find someone like this.

I'm afraid your argument is not a sound one my friend.MINE IS - YOURS IS NOT. I appreciate the good intentions you have about warning the world of the dangers of fairgates, but other people are entitled to their oppinions as well. NOT IF THEY ARE NOT BASED ON FACT. To simply dismiss their constructive criticisms as abuse does not help your case.

Just another note. If you are a Police Officer as you claim to be, why are you using the fairgates in the first place???WHEN I WORKED AT JUVENILE HALL I WAS A SWORN OFFICER. I HAVE MOVED ON TO OTHER NOBLE CALLINGS.
