No Food No Beverages?
If you aren't supposed to eat or drink on BART why do the ticket agents let people walk in carrying a cup of coffee? I see it all the time. With the fines they'd be able to finally clean the filthy trains!

If they aren't drinking it ...it isn't a crime to have it .
And if the people USING BART acted like concerned patron and CLEANED up their own messes it wouldn't be an issue.
But since we live in the Nanny state...we can just let everyone else wipe our asses.

The no
The no eating/drinking/smoking law is enforceable under under a state law. The law specifically states "No eating, drinking or smoking where prohibited by that system." BART has the authority to prohibit these actions wherever it wants to on BART property. Eating, drinking and smoking is always prohibited once you enter the fare gates into the paid area, NO EXCEPTIONS. There doesn't have to be a sign everywhere you look as long as there is at least one sign visible when you enter the station.
In summary, YOU CANNOT EAT, DRINK, or SMOKE ON THE PLATFORM or on the TRAIN or inside the PAID AREA OF THE STATION, or anywhere else that has a sign that prohibits those actions.
There is no law against bringing food or beverages on the train, but if you feel the urge to sip that coffee or take a bite of your burrito, you are committing an infraction and face a fine up to $250.00 and/or community service.
To the original poster: BART generally sees very little of any fine it collects for this minor violations. The fine is a maximum of $250.00, but the judges rarely stick anyone with that. The average fine is $50.00 - $100.00 and that doesn't even come close to the court costs and the overtime for the officer who issued the citation. It's really a screwed up situation.

Average weekday ridership on
Average weekday ridership on Caltrain is approximately 32-34,000. It's approximately 350,000 for BART's average weekday ridership. Caltrain's ridership comes out to less than 10% of BART's. Caltrain doesn't have upholstered seats or carpeting. BART's midday service is 15 minute headways and 20 minutes at night. Caltrain offers midday service of an hour or so between trains and about two hours at night. I don't know what commute headways are for Caltrain but it's not every 15 minutes or less. Of course Caltrain cleaner.

Love those Stats!! Often times when people are comparing things, they do not do so apples to apples. Caltrain is cleaner, due to the amount of time between trains, a fact most people seem to miss....Very good, I like that.

Not one to let the facts get in the way of your bigotry, eh? Even though Caltrain has proof of payment, there also conductors on the trains. Conductors don't sell tickets. My guess is that fare evasion is not a big problem.
As I stated earlier, BART has 10 times the ridership of Caltrain.

Pigs are pigs and can come in all shapes and colors. If BART's lax enforcement lets more pigs on its trains than Caltrains does, that's a fact and bigotry does not necessarily have anything to do with it. Sounds more like BART may have ten times the riders, but many more times the pigs than Caltrain.
