That is great! How do fight
That is great! How do fight a ticket in court when you are sitting under a two foot square sign advising you of the violation? I have no problem writing those guys a cite! :P
The 2 riders in the picture
The 2 riders in the picture are not violating any BART rules and cannot be given a citation. That, according to the BART response I received on this subject. See http://www.bartrage.com/node/1708
According to BART:
"If such violators are observed consuming their beverages by the BART Police, they are subject to a citation. However, if simply carrying a beverage and not drinking or eating, there is no violation."
Next time, snap the picture with the straw in their mouths. However, in order to be given a citation, BART police would have to have personally witnessed the act, and would also have to be able to prove the passengers actually were drinking, rather than just chewing on the straw.

Can it be argued that because the straw was in the cup they were in violation since the straws would not be in the cups if the drinks were simply being transported.

So, if I were to carry, say, a dripping ice cream cone onto BART and just hold it it would be okay. Provided of course that I don't drip all over BART. Myself is okay. But not onto BART. Would that be okay. Not to push the letter of the law or anything, but that's pretty much what they are saying. ;)

totally weak post; there are so many more MAJOR offenses than two dudes sitting there with covers on their drinks who aren't even drunk or have any other nasty food.

i am beginning to seriously question your judgment. first of all, that was an awesome post. two guys with sodas sitting directly under the largest no eating or drinking sign in the entire bart system.
second, that pic was not taken with a cell phone: "fortunately i had my CAMERA with me."
