dumbass of the day

this morning there is a kid about 5 years old sitting in one of the ADA seats. i assume his mom is sitting in the ADA seat next to him as they looked similar, but i cannot be sure as neither she nor anyone else on the train acknolweged his existence my entire ride from WC to montgomery. anyway, assuming she was his mom:
1) this is an SRO train and your kid is small - at least put him on your lap so someone else can use the seat.
2) as i walk past them to exit the train, i realize that the kid is sucking and licking the seat. yes, sucking and licking a BART seat. whoever his mom/dad/babysitter is needs a visit from CPS. that is disgusting.

I'm going to play devils advocate here.
A 5 year old riding BART is probably paying the same fare you are. Why should he have to ride in his mother's lap? Would you expect an 8 year old riding with his mother, or a petite woman riding with her SO to ride in a lap?
edited to add- on a crowded train, if I can get 2 open seats together, all 3 of my older kids (5, 9 and 11) sit together. Not terribly comfortable, but at least they're all siting that way.

the kid in his own seat didn't bother me as much as the licking the seat did. although, i still think that lap sitting was an option - especially since this was an ADA seat.
as far as when lap sitting is no longer an option, i think it is a judgement call on the parent's part. a five year old is defintiely small enough (on average) to lap sit for 20-30 minutes. as for petite women, once again, it is a judgement call. we had a house party once and someone left a coat. we emailed everyone the next day to ask if anyone wants to claim the size 16 petite peacoat, to which one of my friends replied: "since when is a size 16 petite???" my wife then informed me that petite just means short. i would not want that particular petite woman sitting on my lap for 40 minutes. judgement call.
